The service object

Intelectsoft provides the Beneficiary with the technical infrastructure for: sending SMS on the Orange, Moldcell and Unite networks to consenting recipients; sending emails to the Beneficiary's own contact list; access to the esm.eservicii.md dashboard and the ISCloudSMS API. Messages are drafted and sent by the Beneficiary; Intelectsoft provides the infrastructure, not the content.

Beneficiary obligations, the essentials

• Recipient consent — mandatory, in writing; a copy within 10 days on request; a 2,000 MDL penalty per non-consented SMS;
• Content — no weapons, drugs, alcohol, tobacco, political ads or phishing; per advertising law 1227-XIII/1997 and consumer protection law 105-XV/2003;
• Format — Sender ID max 11 characters; 160 Latin / 70 Cyrillic characters;
• Schedule — sending 10:00–19:00, not on official holidays.

Payment and rates

The invoice is issued at the end of each calendar month for delivered SMS plus any difference up to the 1,000 SMS minimum traffic; the payment term is 5 business days; the late penalty is 0.1% per day. The SMS price can only be changed by the mobile operators, with notice and an addendum.

Personal data

The Beneficiary is solely responsible for how it collects its recipients' data and for complying with Law 133/2011 on personal data protection. Intelectsoft processes only the data needed for the contract (company data, representative data, usage logs) and shares it strictly with the mobile operators for delivery, the partner bank for payments and public authorities only on legal request. Intelectsoft does not sell or rent data; accounting documents are kept 10 years (the Tax Code), account logs for the contract duration plus 90 days.

Suspension, termination, confidentiality

Intelectsoft may suspend the service within 24 hours of notice for contractual breaches, within 7 days for other breaches, or immediately if the Beneficiary's activity endangers the operators' networks. Either party may terminate unilaterally with 30 days' written notice. Confidentiality of technical and commercial information lasts for the contract duration plus 3 years.
